Terms of Service

Version: 31 October 2026. These terms apply to all services of Invoice Duty Guard provided to businesses.

1. Scope

These terms govern all contracts between DRUKXPERT.PL sp. z o.o., ul. Małopolska 41, 45-301 Opole, Poland (the “Provider”) and customers on the use of the Invoice Duty Guard service (invoiceduty.de). The service is offered exclusively to businesses (traders within the meaning of § 14 of the German Civil Code), public-law entities and public-law special funds. By ordering, the customer confirms that it acts in the course of its trade, business or profession. We do not sell to consumers. Conflicting or deviating terms of the customer do not become part of the contract.

2. Description of the service

The Provider automatically evaluates published legal acts of the European Union (EUR-Lex) and data from the EU TARIC database and provides the customer, for an entered invoice line, with information on applicable anti-dumping and countervailing duties (producer rate by TARIC additional code, rate without invoice declaration, rate for all other companies, amounts, wording of the producer declaration, legal basis, audit protocol). The service is automated information on published law. It is not legal, tax or customs advice, not an assessment of the individual case and not customs representation. The stated data status forms part of the service. The customer checks classification, origin and the content of the commercial invoice on its own responsibility; only the assessment of the competent customs office is binding.

3. Conclusion of contract

The presentation of services on the website is not a binding offer but an invitation to order. A contract for a single report or a package is concluded upon payment confirmation by the payment provider Stripe; a contract for the partner tariff or a pilot access upon the Provider’s confirmation by e-mail. Entries can be corrected at any time before submission. Contract languages are German and English. The Provider does not separately store the contract text; the customer receives confirmation and invoice by e-mail.

4. Prices and payment

All prices are in euro, net of statutory VAT where applicable. The customer’s VAT identification number must be provided at checkout; for businesses from other EU member states the reverse-charge mechanism applies (Art. 196 of the VAT Directive) and the tax liability passes to the customer. Single reports and packages are paid via Stripe; the report is unlocked immediately after receipt of payment. Under the partner tariff the Provider invoices monthly; invoices are payable within 14 days without deduction by bank transfer. In case of default, statutory default interest for commercial transactions applies. Invoices are transmitted electronically; the customer agrees to this.

5. Check account and credit

The customer receives a check account key. It must be kept confidential; the customer is responsible for use by its employees and by persons to whom it passes the key. Package credit does not expire and is not paid out; if the service is discontinued, the Provider refunds unused credit pro rata. A lost key is re-sent to the e-mail address stored in the account.

6. Rights of use

The customer may use reports internally, towards its clients and towards customs authorities and may re-invoice them to clients. Reselling the service as such, systematic extraction of the website (scraping) and use for building a competing data set are not permitted.

7. Availability and third-party data

The Provider aims at 99 % availability as an annual average; maintenance windows and disruptions at third parties (hosting, payment provider, EUR-Lex, TARIC) are excluded. Data sources are reconciled daily; the Provider gives no warranty that published legal acts are already implemented in TARIC or that the sources are complete and error-free.

8. Warranty and liability

The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. In case of slight negligence the Provider is liable only for breach of essential contractual obligations whose fulfilment is a prerequisite for proper performance and on whose observance the customer may regularly rely, and limited to the typical, foreseeable damage, but at most ten times the fee paid for the report concerned and EUR 1,000 in total per contract. Post-clearance duty claims, interest, fines, penalties and lost profit resulting from the customer’s decisions based on the information provided are not compensated. Liability for the accuracy of third-party data (EUR-Lex, TARIC) is excluded where the Provider reproduces such data unchanged.

9. Data protection and processing on behalf

The processing of personal data is governed by the privacy policy. Where the customer enters data of its clients, the parties conclude a data processing agreement under Art. 28 GDPR on request.

10. Term and changes

Contracts for single reports and packages end with performance. The partner tariff runs for an indefinite period and may be terminated by either party with one month’s notice to the end of a month; a pilot access ends automatically after 14 days unless otherwise agreed. The Provider notifies partner-tariff customers of changes to these terms at least six weeks before they take effect by e-mail; if the customer does not object within this period, the changes are deemed accepted, which the Provider points out in the notification.

11. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a public-law entity or a public-law special fund, the exclusive place of jurisdiction is Opole (Poland); the Provider may also sue the customer at the customer’s general place of jurisdiction. Should individual provisions be invalid, the remainder of the contract remains in force.
